1. Introdução

Boas-vindas à Unite Gay Network ("UGN", "nós" ou "nosso"). Estes Termos e Condições ("Termos") regem seu acesso e uso do nosso site, aplicativos e serviços (em conjunto, os "Serviços"). Ao acessar ou usar os Serviços, você concorda em cumprir e ficar vinculado a estes Termos.

Se você não concordar com estes Termos, não use, acesse nem interaja com nossos sites, aplicativos ou qualquer outro aspecto dos nossos serviços. Interrompa qualquer interação imediatamente.

Incentivamos você a ler estes Termos com atenção antes de usar nossos serviços. Ao continuar a usar os Serviços, você declara que leu, entendeu e concordou com estes Termos.

2. Elegibilidade

Você precisa ter pelo menos 18 anos para usar os serviços.
Unite Gay Network (UGN) is designed for homosexual and bisexual men. By registering, you confirm that you identify and represent yourself as a man and are seeking a community specifically tailored to this demographic.
Ao se cadastrar, você também confirma que todas as informações fornecidas são precisas, atuais e completas.

3. Associação e assinaturas

Unite Gay Network (UGN) is free to join. All core features, including access to discussions, groups, and events, are available to members at no cost.

However, we offer an optional paid subscription (“Verified Membership”) for users who wish to unlock additional benefits. These include:

Preços da associação verificada (sem IVA de 21%):

€10 por mês
€27 por trimestre
€100 por ano

O IVA será calculado e adicionado no checkout de acordo com as leis holandesas aplicáveis.

Payments can be made automatically via credit/debit card or PayPal. Manual payment methods such as iDeal, Apple Pay, and Google Pay are also supported (including card-based payments).

If you choose manual payments, your first invoice may be billed pro-rata to align with your selected billing cycle. Subsequent payments will follow your chosen billing frequency (monthly, quarterly, or annually).

By subscribing to Verified Membership, you agree to provide accurate payment details and authorize UGN to charge your selected payment method accordingly.

Direito de cancelar

If you reside in a jurisdiction with a statutory cooling-off period (e.g., the European Union), you have the right to cancel your Verified Membership and receive a full refund within 14 days of subscribing. You may cancel by emailing us at support@unite.gay

If you access or use Verified Membership benefits during this 14-day period, UGN reserves the right to deduct a proportional amount from your refund based on your usage.

Your Verified Membership will remain active until the end of your current billing cycle after cancellation.

4. Propriedade intelectual e uso de conteúdo

Unite Gay Network (UGN) uses third-party tools, assets, and resources, including but not limited to website-building tools provided by Wix.com and images sourced from platforms like Pexels.com and Unsplash.com, in accordance with their respective terms of use. UGN does not claim ownership of these assets and respects the intellectual property rights of their creators.
Users are prohibited from copying, modifying, distributing, or reusing any content on UGN’s platform, including third-party assets, without explicit permission from the respective copyright owners or licensors.
The Unite Gay Network (UGN) logo and brand design are trademarks of UGN. While certain elements may be created using third-party tools, the specific arrangement, color scheme, and usage are proprietary to UGN. Unauthorized use of the UGN brand or logo is prohibited.
UGN incorporates images from platforms such as Pexels.com and Unsplash.com, which are free to use under their respective licenses. Users are responsible for ensuring they adhere to these licenses when interacting with or repurposing such images.
UGN does not claim ownership of all visual and digital elements on the platform. These include tools, fonts, and stock photography provided under licenses from third-party providers. While UGN customizes and uses these elements in compliance with their terms, ownership remains with the original creators or licensors.
UGN respects the intellectual property rights of its members. If you believe your content has been used without authorization, please contact us immediately at support@unite.gay.
Users are prohibited from creating derivative works using UGN’s branding, design, or assets without prior written consent.

5. Responsabilidades da conta

Avise a UGN imediatamente sobre qualquer uso não autorizado ou suspeita de violação de segurança.
You are not allowed to share your account with anyone. If we find that an account is being shared, it will be terminated immediately without prior notice.
Account sharing includes, but is not limited to, providing your login details to others or allowing others to access your account.

6. Conduta do usuário

Ao usar a Unite Gay Network (UGN), você concorda em:

Use the platform solely for its intended purpose: fostering community and engagement among homosexual and bisexual men.
Respect the rights, privacy, and safety of other users, and refrain from engaging in harmful behavior, including:
- Fraude, impersonação ou distorção da sua identidade.
- Tentativas de phishing ou solicitação de informações pessoais de outros usuários.
- Spam, publicidade ou promoção de produtos ou serviços não relacionados.
- Enviar, compartilhar ou vincular conteúdo com vírus, malware ou código prejudicial.
Avoid exploiting or attempting to exploit the platform’s features in ways that disrupt or harm other users' experiences.

Consequências das violações;

UGN reserves the right to suspend or terminate your account if you engage in any prohibited activities or fail to comply with these conduct rules.
Conforme a gravidade da violação, a UGN pode comunicar atividades ilegais às autoridades competentes.
If you witness violations of these rules, we encourage you to report them to UGN moderators or through our contact form.

7. Diretrizes da comunidade

Para fomentar uma comunidade segura e respeitosa, espera-se que os membros:

Trate os outros com respeito e dignidade.
Evite publicar conteúdo discriminatório, ofensivo ou prejudicial.
Não pratique assédio, bullying ou discurso de ódio.
Report inappropriate behavior to UGN moderators. Members can report such content or behavior using the reporting tools available within the network. Alternatively, you can contact us via email at support@unite.gay or through our contact form at unite.gay/contact.

Members are solely responsible for the content they post, share, or engage with on the platform. By using UGN, you acknowledge and accept that your profile, posts, and interactions are at your own risk.

UGN allows the use of display names instead of real names for engagement in the community. Members are encouraged to exercise caution and discretion when sharing personal information.

Violation of these guidelines may result in account suspension or termination. Users are also expected to comply with local laws when posting or engaging on the platform.

8. Propriedade e uso do conteúdo

You retain ownership of any content you post on UGN but grant us a non-exclusive, royalty-free, worldwide license to use, modify, and display your content to provide and promote our services.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
By using our services, you consent to the collection and use of your data as outlined in the Privacy Policy.

10. Atividades proibidas

Você concorda em não:

Usar os serviços para qualquer finalidade ilegal ou não autorizada.
Publicar ou transmitir vírus, spam ou software malicioso.
Tentar obter acesso não autorizado a contas de outros usuários ou sistemas da UGN.
Explorar a plataforma para fins comerciais sem autorização prévia.

11. Encerramento

Unite Gay Network (UGN) reserves the right to suspend or terminate your account for violating these Terms or engaging in activities detrimental to the community.
Additionally, UGN reserves the right to terminate your account for any reason or no reason at all, at our sole discretion.
You may cancel your membership at any time through your account settings, or by contacting us at support@unite.gay or via our contact form at unite.gay/contact.

12. Isenções de responsabilidade

13. Limitação de responsabilidade

To the maximum extent permitted by law, Unite Gay Network (UGN) and its affiliates, officers, employees, agents, and partners will not be liable for any:

Perda de lucros, dados, goodwill ou outras perdas intangíveis resultantes de:
- Seu uso ou a impossibilidade de usar os Serviços.

UGN’s total liability for any claims under these Terms, including for implied warranties, is limited to the amount you paid to us in the last 12 months for your Membership. This cap applies only to claims not excluded by the disclaimers above.

Jurisdiction-Specific Provisions: Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for damages, including caps such as the amount you paid in the last 12 months. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

14. Alterações nos termos

Unite Gay Network (UGN) reserves the right to modify these Terms at any time to reflect changes in our Services, legal requirements, or operational practices.
Alterações significativas nestes Termos serão comunicadas aos membros por:
Notificações por e-mail enviadas ao endereço associado à sua conta e/ou
Avisos publicados na plataforma.
The updated Terms will become effective immediately upon posting unless otherwise stated. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must discontinue use of the Services and may cancel your Membership by contacting us at support@unite.gay or through the contact form at unite.gay/contact.

15. Lei aplicável

Estes Termos são regidos e interpretados de acordo com as leis dos Países Baixos.
Any disputes arising from or related to these Terms, including their validity, interpretation, or enforcement, will be resolved exclusively in the courts of the Netherlands.
If any provision of these Terms is found to be invalid or unenforceable under Dutch law, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.
